Bureau of Air Quality

  • Some air quality reports require annual submittals of information. Check your permit to determine if you are on an annual reporting schedule. These reporting schedules are based on the dates the air quality operating permit is issued and varies from facility to facility. 
  • 5-year OSIL reporting: For an air quality source who has an OSIL condition in their permit. Reports of activities conducted under this permit flexibility condition shall be submitted to SCDES via ePermitting every five (5) years. The 5-year requirement is based upon the issuance date of the air quality operating permit. Notifications are provided via ePermitting. 
  • Semi-Annual Air Compliance Monitoring Report - Check your permit to determine if you are on a quarterly or semi-annual reporting schedule. Semi-annual & quarterly reports are due based on the effective permit date. Please contact your compliance reporting manager if you have questions regarding your submission due dates. 
    • MACT/NESHAP quarterly and semi-annual due dates are based on the category's requirements in the federal regulation. Some NESHAPS only require reporting when there is a malfunction or deviation. Please contact your MACT/NESHAP Compliance Manager for further information. 
    • RMP: Initial RMP documentation must be submitted before covered chemicals are on-site above threshold quantities. Resubmissions are due within 5 years of the previous submission. 
  • The Annual Compliance Certification for Title V facilities (TVACC) are due once a year. The due date is based on the effective date of the permit.
  • Annual Contact Update: ePermitting is the main system for SCDES to communicate information with facilities. Without updated contact information the facility will not receive notifications regarding reports, etc, required to be submitted. Asbestos Program Area Information

  • If waste is generated in a calendar quarter, the Quarterly Disposal License is active for one year; Waste Shipment Record schedules are due back to SCDES within 45 days of the expiration date of the Quarterly Disposal License. See the Asbestos Licensing page for more information.

*Note: Temporary waste may be stored for Facilities that fall under Section XX of the asbestos regulations. Licensees may indicate storage in lieu of landfill and revise when materials have accumulated and are ready to be taken to the landfill.

Bureau of Land and Waste Management

Radiation Protection Program Information

Program area contains X-Ray facilities/vendors, Mammography & Tanning. Due dates are based on issuance of permit or date of installation of equipment.

  • Facility Ownership Changes - Report any ownership change on DES 0845 (Facility Registration Approval Request Form) within 30 days of the change. 
  • Facility Information Changes - For x-ray facilities, any name changes, relocations, facility contact updates, billing contact changes, RSO changes, etc. must be reported on DES 4262 (X-Ray Facility Information Change Form) within 30 days.
  • New X-Ray Machine Registration - Any newly installed x-ray equipment must be registered on DES 0819 (Registration and/or Deletion of X-Ray Producing Machines) within 30 days of installation.
  • Operating Schedule for Out-of-State X-Ray Facilities - Out-of-state x-ray facilities must submit an operating schedule at least 5 days prior to using an x-ray machine in South Carolina. This is reported on the DES 0461 (Operating Schedule for Out-of-State X-Ray Facilities Form).
  • Sale or Installation of X-Ray Equipment (Vendors) - If x-ray equipment is sold or installed in South Carolina during a given month, submit DES 0823 (Report of Sale or Installation of X-Ray Equipment) for that month.
  • Vendor Information Updates - Changes such as address updates, name changes, RSO changes, contact changes, etc. must be reported on the DES 25-0013 (X-Ray Vendor Report of Change Form) within 30 days.
  • Vendor Ownership Changes - Any ownership change for a vendor must be reported on the DES 0824 (Vendor Registration Form) within 30 days of the change.
  • Annual Invoices 
    • X-ray & Vendors - Each registrant shall pay an annual registration fee per x-ray equipment tube possessed, except for Combination Rad/Fluoro. Vendors and Out-of-State Facilities shall pay an annual flat fee. Payment of fees shall be made in accordance with the instructions of a "Statement of Fees Due" issued annually by the Department. The annual registration fee shall be due no later than thirty (30) calendar days after the date of the “Statement of Fees Due.” 
  • Misadministrations 
    • Therapy – 24 hours after the discovery of the misadministration 
      • Submit a written report within fifteen (15) calendar days 
  • Overexposures – Immediate notification. Each registrant shall submit a written report within thirty (30) calendar days after learning of any of the following occurrences.
  • Corrective Action Responses
    • Mammography 
      • If the MQSA (Mammography Quality Standards Act) report results in a Level 1, repeat Level 1, or repeat Level 2 finding, a written Corrective Action Plan shall be provided to the Department within fifteen (15) calendar days of the date of citation. 
      • If the MQSA report results in a Level 2 or repeat Level 3 finding, a written Corrective Action Plan shall be provided to the Department within thirty (30) calendar days of the date of citation.
    • X-Ray - All violations shall be adequately corrected within sixty (60) calendar days from the date of citation. The Department shall be notified in writing of all action taken to correct the violations. 

Indoor Tanning Program Information

Tanning - Tanning bed fees are due at the time of registration and every year on July 15.

  • Tanning Facility Ownership Changes - Report any ownership change, new installed tanning equipment, and facility information changes on DES 0826 (Registration of Tanning Equipment) within 30 days of the change. The Tanning program is also in ePermitting, so we encourage everyone to utilize ePermitting for tanning registrations.

Hazardous Waste Program Information

  • The Hazardous Waste Biennial Report is not a state requirement since the state regulations are more stringent with quarterly reporting found in R.61-79.264.75. The Federal Register (40 CFR 264.75) requires a Biennial Report to be submitted to USEPA's Biennial Reporting portal or RCRAInfo on even-numbered years by March 1.
  • All Large Quantity Generators are required to submit an annual notification (EPA form 8700-12). 

Site Contact Update

  • If a site contact changes then they must submit the EPA form 8700-12 within 30-days. Instructions for Hazardous Waste Submission Form Packet

Bureau of Water

Agricultural Program Info 

  • Annual fee due dates vary. Fees are due 30 days after the invoice is issued from finance.  Annual Fee Information
  • Annual broker reports and permitted facilities which are required to submit annual reports have variable due dates based on permit issuance date.
  • CAMM certifications are due within one year of receiving permit (new) or every five years for renewals

Groundwater Program Information

  • Groundwater monitoring reports (GMRs) are due based on the monitoring frequency outlined in the permit. (ie: Monitoring frequency is once a year – Jan. 28 due date, 2x a year – April 28, 3x a year – July 28, 4x a year – Oct. 28. 
    • Some wastewater permits have other schedules, such as annual reports. Those can have variable due dates similar to those mentioned above (annual, semi-annual or quarterly). 
    • Sometimes the GMRs and report requirements are contained in a Consent Agreement, Consent Order, or a Post-Closure Monitoring agreement and are not permit-based. In these cases, the permit could be either active or closed and the due dates are based on the compliance, enforcement and remediation documents. 
    • There are also due dates associated with NPDES Compliance Schedules. Examples include submitting maps, nutrient management plans, monitoring well elevations (above mean sea level), or any number of items that are needed for their permit, which they have not yet submitted. In the past, they were often given 120 days to submit these items after the permit issuance.

Industrial Stormwater Program Information 

  • Annual Employee Training 
  • Comprehensive Site Inspections are required Annually (Defined as July 1 – June 30 of each calendar year). 
    • Water Quality Assessment for Impaired Waters 
    • Non-Stormwater Certification 
  • Quarterly Visual Assessments 
  • Routine Facility Inspections (Quarterly)   
  • Monitoring 
    • Quarterly benchmark monitoring (see Part 6.2.1).  If permittee is below parameters for 4 quarters, they are not required to test again until the next IGP cycle; 
    • Effluent monitoring (Annual); 
    • Annual effluent limitations guidelines monitoring (see Part 6.2.2):
      • Discharge monitoring reports (DMRs) shall be submitted once per year by the 28th day of the month following the end of the monitoring period.   
    • Impaired waters monitoring (see Part 6.2.4) 
      • Discharges to impaired waters without an EPA approved or established TMDL: Once per year of Permit, unless compliance with water quality standard is met, and the 4th year of Permit. 
      • Discharges to impaired waters with an EPA approved or established TMDL: Not less than 4 times in a 12 month period beginning the first full quarter after NOI submission.  Monitoring must continue annually until the water quality standard is met.

MS4 Program Information

Annual Report Submission Requirements 

  • Unless a NEW PERMITTEE is relying on another entity to satisfy its NPDES permit obligations: 
    • The first annual report must be submitted to the Department fourteen months after the effective date of permit coverage.  
    • Subsequent annual reports shall be submitted every twelve months from the scheduled date of the first submittal.  
    • The last annual report shall be submitted, as part of renotification, 180 days prior to expiration date of the permit, see Part 2.5, Renotification.  
    • While, and if, the permit is continued, Annual Reports will be due on the anniversary date of the NEW PERMITTEE certificate of coverage. See Parts 2.6, Continuation of the Expired Permit.  
  • Unless an EXISTING PERMITTEE is relying on another entity to satisfy its NPDES permit obligations, or unless the Department requires more frequent reports: 
    • The first report covering years 1 and 2 must be submitted to the Department twenty- seven (27) months after the effective date of the permit.  
    • The following annual report, covering years 3 and 4, shall be submitted 180 days before the permit expiration date as part of the renotification. See part 2.5.  
    • While, and if the expired permit is continued, Annual Reports are due every year on the anniversary date of the expired permit. See Parts 2.6, Continuation of the Permit.

Monitoring Plan Schedule 

  • For EXISTING PERMITTEES, as defined in Part 1.4.1 of this permit, within 12 months of the effective date of permit coverage for existing TMDL. 
  • For NEW PERMITTEES, as defined in Parts 1.4.2 – 7 & 2.1.2, authorized to discharge storm water from their SMS4 for the first time under this permit (or, for EXISTING PERMITTEES, where additional SMS4 areas annexed under 1.4.8 or SMS4 boundaries have expanded) within 24 months of the effective date of permit coverage for existing TMDL. 
  • Monitoring and Assessment Plans, applicable to EXISTING and to NEW PERMITTEES under parts 3.2.1.1.1 & 2 above respectively, shall be submitted within 12 months of the EPA-approval or establishment of new TMDL (Effective Date of the TMDL), after the first year of permit coverage.

Addition for TMDL Implementation and Analysis Plan

  • Within 48 months from the Effective Date of this permit, or 48 months from the new TMDL effective date, for EXISTING PERMITTEES, and 
  • Within 60 months from the Effective Date of the Certificate of Coverage, or 60 months from the new TMDL effective date, for NEW PERMITTEES.

  • Annual invoices for permits are generated around Jan. 15 of each year. Permits are issued once the fees are paid.
